General Terms and Conditions of Use and Sale

Introduction and Preamble #

These General Terms and Conditions of Sale (GTCS) govern access to and use of services offered by MineStrator.com, a French multi-title game server hosting platform published by OctoGency SARL. MineStrator.com provides hosting solutions suited to a wide range of supported games (Minecraft, ARK, Garry's Mod, Rust, Palworld, Valheim, Factorio, and many other titles) and serves both individuals and businesses, in France and internationally. These GTCS cover the entirety of offers, options and services available on the site, and constitute the full body of contractual provisions applicable between MineStrator.com and its Clients. By registering and using the services, the Client acknowledges having read and accepted these GTCS without reservation.

Definitions #

  • Client: Any individual or legal entity using the services of MineStrator.com.
  • User Account: The personal space created by the Client upon registration on the site.
  • Service: All game server hosting services, including subscription plans and customisable options.
  • Contract: The entirety of the contractual commitments arising from the Client's acceptance of these GTCS.
  • Maintenance: Operations for updating, upgrading, or repairing the service, whether scheduled or not.
  • SLA (Service Level Agreement): Commitment to service availability and quality as defined below.
  • Credits: Internal virtual currency of the MineStrator.com platform, usable exclusively for the purchase of Services, options or participation in promotional games. Credits have no monetary value outside the platform, are neither convertible back to euros, nor transferable between accounts.
  • Tokens: Internal virtual units granted to the Client for each eligible payment increment (see dedicated section on the Wheel of Fortune), usable exclusively to participate in MineStrator.com's promotional games.
  • MyBox / MyBox Perf / MyBox Free: Designates the various game server hosting offerings provided by MineStrator.com, with distinct technical and pricing characteristics (allocated resources, supported game, commitment duration, etc.).
  • Chargeback (payment dispute): A payment dispute initiated by the Client with their credit card issuer, PayPal, or any other payment provider, with the aim of obtaining a refund of the transaction.
  • DPO (Data Protection Officer): Person in charge of monitoring GDPR compliance within OctoGency. Reachable at dpo [at] octogency.com for any request relating to the Client's rights over their personal data.
  • Minor: Within the meaning of these GTC, refers to any person under eighteen (18) years of age. Subscription conditions by a Minor are specified in the dedicated section.
  • Best effort: A commitment by which MineStrator.com undertakes to implement reasonable means to achieve a given result (for example, retaining an archive for an announced maximum duration), without formally guaranteeing the result. For operational reasons (periodic cleanup, storage capacity needs, technical incident, infrastructure evolution, etc.), a best-effort commitment may not be honored to its full term, without engaging MineStrator.com's contractual liability or giving rise to compensation.

This website is published by OctoGency SARL, a company registered under number 844 727 594 R.C.S Castres.

Acceptance of the GTCS #

Any registration, order, or use of the services of MineStrator.com implies unconditional acceptance of these General Terms and Conditions of Sale. No use of the site or services may be made without the Client's express electronic consent to these GTCS in their entirety, expressed at registration or upon validation of an order (dedicated checkbox, checkout flow validation). Such electronic consent has the same probative force as a written consent, in accordance with Articles 1366 and 1367 of the French Civil Code.

Legal capacity of the Client: The Client declares to have full legal capacity to subscribe to the Services. In accordance with Articles 1146 to 1148 of the French Civil Code, non-emancipated minors are legally incapable of contracting; the contract must therefore be entered into by their legal representative (parent holding parental authority or guardian), acting in the name and on behalf of the minor, and standing as joint and several guarantor of all contractual obligations (payments, compliance with the GTCS, indemnification of any damages). As a matter of tolerance, MineStrator.com may accept that a minor aged sixteen (16) to seventeen (17) inclusive uses the Service subject to prior express written authorization from their legal representative, the latter standing as joint and several guarantor on the same terms. MineStrator.com reserves the right to request proof of this authorization at any time, and to suspend or terminate the account in case of absence, false declaration or dispute. The subscription of a contract by a minor outside these conditions may be canceled at the request of their legal representatives.

Access to the Site and Services #

  • Access Conditions: Access to the site requires registration and the creation of a User Account.
  • Security: The Client agrees to maintain the confidentiality of their access credentials and to immediately notify MineStrator.com in the event of any unauthorized use of their account.
  • Availability: The service is accessible 24/7, subject to interruptions for maintenance or force majeure events.

Description of the Services Offered #

  • Hosting Offers: MineStrator.com offers game server hosting plans in the form of subscriptions on cycles of 1, 3, 6, 12, and 24 months, without any commitment, along with various customisable options. The offer covers a wide range of supported games, regularly expanded based on market releases and community demand.
  • Features: Each plan includes a set of predefined features, including: a web control panel for server management (start, stop, restart, real-time console), SFTP/FTP access for uploading and downloading files (worlds, configurations, plugins, mods, scripts), an integrated backup system, plugin and modpack management for the hosted game, real-time monitoring of allocated resources (CPU, RAM, disk), and technical support accessible through multiple channels. The specific feature list may vary depending on the plan tier chosen (MyBox, MyBox Perf, MyBox Free, etc.) and is detailed on each offer's page.
  • Proper Use: The Client agrees to use the services in accordance with applicable laws and these General Terms and Conditions of Sale.
  • Free and trial offers: MineStrator.com offers free plans (MyBox Free) and trial plans (MyBox Trial). The trial offer currently consists of a MyBox12 or MyBoxPerf12 of the Client's choice, lasting twelve (12) hours and limited to one use per Client per week. The specific terms (allocated resources, eligibility conditions, technical restrictions, optional conversion to a paid plan) are detailed on each offer's page and may evolve at any time. These offers are strictly limited to one account per natural or legal person. Any attempt to circumvent this limitation (creating multiple accounts, identity spoofing, use of disposable email addresses or different IP addresses to multiply registrations) will result in the immediate suspension of the affected accounts, without notice or possible refund.

Order and Contract Formation #

  • Ordering Process: Orders are placed directly on the website by selecting the desired package, providing the required information, and confirming the order.
  • Contract Formation: The contract is formed upon order validation and confirmation sent by MineStrator.com via email.

Price, Payment, and Billing #

  • Pricing: The applicable rates for subscription plans and options are clearly indicated on the site, in euros (EUR) and all taxes included (VAT inclusive), including French VAT at the rate in force. Subscriptions paid by credit card or PayPal are subject to automatic renewal at the end of each cycle (with no commitment); the Client retains the ability to disable automatic renewal or terminate their subscription at any time through their client area, with no fees or justification required.
  • Payment Terms: Payments are made through secure platforms (PayPal, Dedipass, Stripe, Paysafecard). MineStrator.com only retains a unique number to identify the Client, while sensitive payment information is managed by the respective providers.
  • Price Revision: MineStrator.com reserves the right to modify its rates at any time. Any price revision shall only apply to future subscription cycles (upcoming renewals) and never to the current cycle already paid by the Client. The Client shall be notified of any rate change at least fifteen (15) days before the renewal date concerned, by email and/or via their client area. This notice allows the Client, where applicable, to disable automatic renewal or to terminate their subscription free of charge before the new rate applies. This procedure guarantees the consumer Client, in accordance with Article R. 212-4 of the French Consumer Code, the possibility to terminate the contract within a reasonable time before the entry into force of the new pricing conditions.
  • Promotional codes and special offers: Promotional codes and special offers provided by MineStrator.com are personal, not cumulative unless explicitly stated otherwise, subject to a validity period indicated at the time of their distribution, and cannot under any circumstances be refunded in euros or credits. MineStrator.com reserves the right to cancel any code used under abusive conditions (resale, multi-accounts, fraud, circumvention of use conditions).
  • Irreversible payment methods: Certain payment methods offered by MineStrator.com, notably Dedipass (micropayments via premium SMS or premium calls) and PaySafeCard, technically do not allow any direct refund to the Client's account. These transactions are final and irreversible upon validation by the payment provider. The Client is expressly informed of this before validation of the payment. Consequently, and as an exception to any applicable refund policies, no direct refund will be made for these payment methods. In cases where a refund would nevertheless be justified (proven technical error attributable to MineStrator.com), it can only be offered in the form of internal credits credited to the Client's account.

Terms of Delivery and Service Activation #

  • Service Activation: The service activation takes place within a reasonable time after the order is validated and subject to the Client's compliance with the technical prerequisites.
  • Technical Conditions: The Client must have an Internet connection and compatible equipment to use the service.

Availability Commitment and Service Level Agreement (SLA) #

  • Guaranteed Availability: MineStrator.com guarantees a monthly service availability of 99.5% excluding scheduled maintenance periods.
  • Scheduled Maintenance: In the event of evolutionary or corrective maintenance, Clients will be informed at least 48 hours in advance by email and through their client area.
  • Compensation Terms: If the observed monthly availability is less than 99.5%, the Client may request compensation in the form of credits, calculated at a rate of 10% of the monthly subscription amount per missing 0.5% increment (up to a maximum limit of 30% of the monthly amount). This compensation request must be made within 7 days of identifying the non-compliance.

Prohibited Uses and Resource Consumption #

  • Automated external backup systems: The use of any automated external backup system consuming server resources (recurring cron scripts, continuous synchronization daemons, real-time replication tools) in parallel with the backup system integrated into the Service is strictly prohibited. The manual download and recovery of the Client's data via the SFTP/FTP access provided by MineStrator.com are however expressly authorized at any time, in accordance with the portability and reversibility commitments described in the dedicated section.
  • Ad-hoc export scripts: The use of external scripts allowing the Client to occasionally download or save their data via SFTP/FTP access is expressly authorized, provided they do not consume server resources in an abusive manner (see "Resource Abuse" clause below).
  • Resource Abuse: In the event of excessive and repeated consumption of the allocated server resources, MineStrator.com reserves the right to suspend the service after a notice of default has remained unaddressed.
  • Illegal activities: Any use of the Service for illegal purposes or contrary to the laws in force (in France or in the Client's country of residence) is strictly prohibited and results in immediate termination of the contract without notice or compensation.
  • Outgoing attacks: Any computer attack originating from the hosted server (distributed denial-of-service attacks — DDoS, port scans, intrusion attempts, exploits, execution of malware or offensive scripts targeting third parties) is strictly prohibited and will result in immediate suspension of the server, without notice or refund, and reporting to the relevant authorities where applicable.
  • Cryptocurrency mining: The use of allocated resources for cryptocurrency mining or any intensive computation diverted from the game hosting purpose (3D rendering, scientific computing, artificial intelligence, etc.) is strictly prohibited, as these activities consume resources in a manner inconsistent with the intended use.
  • Scraping and third-party data collection: The use of the Service to perform large-scale scraping (large-scale automated collection of data from third-party sites), spam or any unauthorized collection activity is prohibited.
  • Multi-accounts and circumvention of limits: The creation of multiple accounts by the same natural or legal person for the purpose of circumventing the limits of free offers (MyBox Free), trial offers, promotional codes, loyalty programs or promotional games is strictly prohibited and results in the immediate suspension of all affected accounts.
  • Resale and sublease: The resale, sublease or provision for a fee or free of charge of all or part of the Service to third parties, without prior written agreement from MineStrator.com, is strictly prohibited.

Maintenance and Updates #

  • Developmental and Corrective Maintenance: MineStrator.com reserves the right to perform maintenance operations, updates, or service enhancements at any time, in order to improve or secure the infrastructure.
  • Notification: In the event of scheduled maintenance that may impact service access, clients will be informed at least 48 hours in advance via email and through their client area.
  • Temporary Interruption: Interruptions caused by these operations cannot hold MineStrator.com liable, within the limits defined by the SLA.

Right of Withdrawal and Termination Conditions #

  • Right of Withdrawal — Express Waiver (short cycles): For subscriptions taken out on a cycle of one (1), three (3) or six (6) months, the services offered by MineStrator.com (game server hosting and related services) are deemed to be services fully performed before the end of the withdrawal period within the meaning of Article L221-28 1° of the French Consumer Code. By validating their order and checking the dedicated box provided in the checkout process, the Client gives express consent to the immediate start of the service and expressly waives their right of withdrawal. This waiver is also reinforced by participation in MineStrator.com's promotional games (notably the Wheel of Fortune), whose acceptance of the rules constitutes an additional waiver of any refund request (see dedicated section).
  • Right of Withdrawal — Long cycles (12 and 24 months): By way of exception, for subscriptions taken out on a cycle of twelve (12) or twenty-four (24) months, the consumer Client retains the ability to exercise their right of withdrawal within a period of fourteen (14) days from the conclusion of the contract, in accordance with Article L221-25 of the French Consumer Code. In such case, the Client shall pay the prorated amount of the Service actually consumed between the activation date and the date of receipt of the withdrawal request by MineStrator.com. The remaining balance shall be refunded to the Client within a maximum period of fourteen (14) days from receipt of the request, using the same payment method as the one used at the time of the order, unless otherwise expressly agreed.
  • Credits and gift cards — Express waiver: The purchase of credits and the purchase of gift cards constitute an immediate delivery of digital content on an intangible medium within the meaning of Article L221-28 13° of the French Consumer Code. Credits are an internal virtual currency with no monetary value outside the platform, neither convertible back to euros nor transferable between accounts. Gift cards constitute a digital code generated and delivered immediately. By checking the dedicated box provided for this purpose in the checkout process, the Client gives express consent to the immediate start of delivery and expressly waives their right of withdrawal. No refund of credits or gift cards, whether used or unused, may be claimed.
  • Termination by the Client: The Client may terminate their subscription at any time through their client area, without any extra fees, given the absence of a commitment. Termination does not imply any refund, but simply stops all automatic charges for upcoming cycles. The current subscription period will continue until its expiration.
  • Termination by MineStrator.com: Except in cases of manifestly proven serious breach (use for illegal purposes, attack on service security, fraud, characterized abuse of resources), MineStrator.com notifies the Client of the alleged violation and grants a forty-eight (48) hour period to remedy it. In the absence of remediation, or in case of serious breach, MineStrator.com may terminate the contract without notice or compensation, in accordance with the principles of French law. In all cases, the Client retains the right to recover their data under the conditions provided for in the "Data Portability and Reversibility" section (in particular the fourteen (14) day post-termination retention).

Payment Disputes, Chargebacks and Fraud #

Any payment dispute (chargeback) opened by the Client with their credit card issuer, PayPal, or any other payment provider triggers the following provisions:

  • Definition of abusive chargeback: A chargeback is considered abusive when it is opened without a prior request submitted to MineStrator.com's customer support and when it concerns a service used for more than twenty-four (24) hours before the dispute is opened. Both conditions are cumulative.
  • Administrative fees: In the event of an abusive chargeback, MineStrator.com is entitled to charge the Client administrative fees corresponding to the actual and documented costs incurred in processing the case (internal administrative costs, evidence file preparation, bank fees passed on by payment providers). The indicative amount is set at €20 per disputed payment. This amount may be adjusted downward depending on circumstances, or, on written justification, upward if the costs actually borne by MineStrator.com prove to be higher. This clause does not have the effect of limiting the judge's power of assessment regarding the manifestly excessive or derisory nature of the sums at stake, in accordance with Article 1231-5 of the French Civil Code.
  • Immediate suspension: As soon as a chargeback case is opened by the Client, MineStrator.com immediately suspends all services associated with the affected account (not just the disputed service) for the entire duration of the case processing, until the dispute is resolved with the payment provider.
  • No service extension: Service time lost during the dispute procedure will not be extended, prolonged or refunded, even if the case is resolved in the Client's favor. The subscription period continues to run normally.
  • Evidence preservation: MineStrator.com retains all evidence necessary to defend the case (connection logs, payment history, email activation confirmations, support communications, explicit acceptance of GTC and waiver checkboxes for the right of withdrawal).
  • Collection procedure: In case of confirmed abusive chargeback and non-payment of invoiced fees within thirty (30) days of notification, MineStrator.com reserves the right to initiate amicable then contentious collection proceedings without further notice, by any legal means available.

Promotional Games and Wheel of Fortune #

MineStrator.com offers its Clients a permanent marketing program composed of several promotional games accessible from the client area, including the Wheel of Fortune, the Mega Wheel Strator and the free Daily Drop wheel. Prizes may take the form of credits, virtual bonuses or physical prizes (gift cards, goodies, etc.).

Token acquisition mechanism: Access to the Wheel of Fortune and the Mega Wheel Strator requires tokens. One token is granted to the Client for every ten (10) euros paid in a single transaction. Combining multiple small payments does not entitle the Client to a token: for example, two payments of €5 do not equal one token, while a single payment of €57 grants five (5) tokens. The Daily Drop wheel is freely accessible at the rate of one use per day per Client.

Full rules (Wheel of Fortune and Mega Wheel Strator)

  1. Use of the Wheel of Fortune is conditional upon a minimum purchase of €10 in a single transaction.
  2. Each €10 increment paid in a single transaction grants access to one (1) token.
  3. Server purchases or renewals, as well as credit purchases by credit card, PayPal or PaySafeCard, count towards token acquisition.
  4. Server purchases or renewals paid with credits do not grant tokens.
  5. A token allows one spin of the Wheel of Fortune. A token expires three (3) months after acquisition and can no longer be used beyond this period.
  6. The use of a token immediately terminates any refund policy (notably the 24-hour post-purchase refund policy) and definitively cancels any other refund possibility for the associated payments.
  7. In the event of winning a physical prize, the Client has one (1) month to claim their prize. Beyond this period, the prize is considered forfeited and the physical prize can no longer be obtained.
  8. MineStrator.com reserves the right to interrupt, suspend or modify the Game at any time in case of force majeure. Changes will be announced via official social media. In the event of prize unavailability, an equivalent prize will be offered.

Daily Drop rules

  1. Use of the Daily Drop wheel is limited to one (1) use per day per Client.
  2. In the event of winning an Amazon gift card, the Client has one (1) month to claim it. Beyond this period, the card is considered forfeited and can no longer be recovered.

Explicit acceptance and waiver

At the start of each gaming session, before the first participation in the Wheel of Fortune or the Mega Wheel Strator, the Client must check two separate boxes expressing their explicit acceptance, which remains valid for all participations made during the same session:

  • A first box certifying that the Client has read and accepted the full rules above.
  • A second box by which the Client expressly waives their right of withdrawal and accepts that the payment associated with the participation cannot be refunded.

Participation in a promotional game therefore constitutes an additional and definitive waiver of any refund request, including in cases where a 24-hour commercial refund policy would initially have applied. This explicit acceptance constitutes opposable evidence in case of subsequent dispute or payment litigation.

Free entry route

In accordance with the rules applicable to promotional games offering a free participation route, MineStrator.com provides a free and permanent participation route to its promotional games program via the Daily Drop wheel. This wheel is accessible to any Client holding a MineStrator.com account, with no obligation to purchase or pay in advance, at the rate of one free use per day per Client. The Daily Drop thus constitutes the free participation route equivalent to MineStrator.com's entire promotional games program, allowing any Client to participate in the games and try their luck to win prizes without spending anything. The prizes available via the Daily Drop may differ in nature and value from those offered via the Wheel of Fortune and the Mega Wheel Strator, but constitute a genuine opportunity to win without purchase.

Affiliate Program #

MineStrator.com offers its users a free affiliate program enabling them to recommend the Services to third parties in exchange for a commission. The program constitutes a sui generis business-introducer arrangement, distinct from the Services supply agreement entered into between OctoGency and the referred Client. The following clauses govern the terms of registration, commission calculation, payment, and termination applicable to the Affiliate.

Scope and nature of the program

The affiliate program is accessible free of charge to any holder of a MineStrator.com account from their customer area. It allows the Affiliate to generate a personalized link (in the form minestrator.com/a/<code>) to share with prospects. OctoGency remains the sole provider of the hosting Services to the referred Client: the order, billing, technical support, and contractual relationship are fully managed by OctoGency, with the Affiliate intervening only at the recommendation stage. A specific Partner regime may be negotiated individually with certain Affiliates having significant activity volume or a strategic partnership: its terms are then formalized through a separate written agreement and do not fall within the standard scale described below.

Registration and eligibility

  • Eligibility: Any holder of a MineStrator.com account may register for the affiliate program, free of charge and with no minimum-duration commitment, from their customer area.
  • Choice of affiliate code: The Affiliate freely chooses their affiliate code upon registration, subject to the following restrictions: the code must not reproduce or imitate protected third-party trademarks, must not contain insulting, defamatory, racist, or contrary-to-public-morals terms, and must not appear in the list of reserved or prohibited codes (including in particular OCTOGENCY, MINESTRATOR, WEBSTRATOR, VLADIMIR, MINEBOARD, as well as any variant creating a risk of confusion with the trademarks of the OctoGency group).
  • Refusal and modification: OctoGency reserves the right to refuse, modify, or withdraw an affiliate code deemed inappropriate, misleading, or contrary to these GTCS, without having to justify its decision and without giving rise to compensation.
  • Waiver: The Affiliate may at any time waive their participation in the program from their customer area. The waiver results in the immediate cessation of new commission attributions, without affecting commissions already earned and not yet paid, subject to reaching the minimum payment threshold defined in the section relating to payment.

Commission mechanics

The commission rate applicable to the Affiliate is progressive and calculated on a rolling thirty (30) day window preceding each transaction by the referred Client. The applicable tier is automatically determined by the number of sales generated by the Affiliate over this window.

  • Commission tiers: 5% for 0 to 9 sales / 10% for 10 to 19 sales / 15% for 20 to 29 sales / 20% for 30 to 39 sales / 25% for 40 sales or more, over the last rolling thirty (30) days. Movement from one tier to the next occurs automatically and applies to subsequent transactions.
  • Calculation basis: The commission is calculated on the amount excluding tax (HT) of the referred Client's validated payment, i.e., the amount including tax divided by the applicable VAT rate (1.2 for the French standard rate of 20%).
  • Attribution and duration: The attribution of a referred Client to an Affiliate becomes effective when that Client finalizes a payment within one hour (60 minutes) of clicking on an affiliate link of the form minestrator.com/a/<code>. Beyond this period, the attribution cookie expires and the Client is no longer linked to the Affiliate. In the event of successive clicks on multiple affiliate links, the last active link prevails (the “last-click” rule).
  • Eligible payments: Commissions are earned on the first validated payment by the referred Client, as well as on the conversion of a free account (for example, MyBox Free) to a paid plan. Renewals and subsequent payments do not give rise to commissions, except where the discretionary recurring regime described below applies.
  • Exclusion of refunded payments: Any payment that is subject to a refund (Client withdrawal, bank chargeback, OctoGency commercial refund) does not give rise to any commission. If a commission has already been credited to the Affiliate's balance before the refund occurs, it is automatically cancelled and removed from the balance, including where it has already been paid out (in the latter case, OctoGency requests its restitution or deducts it from future commissions).

Discretionary recurring commissions

By default, the commission is paid only on the first validated payment of each referred Client. Renewals and subsequent purchases do not give rise to any commission. By way of exception, a recurring commission regime may be granted individually to certain Affiliates, on the basis of a specific written agreement between OctoGency and the Affiliate. This agreement must explicitly define the fixed duration of the recurrence and, where applicable, the rate applicable to recurring payments (which may differ from the standard scale). Recurrence is never granted for life, does not renew tacitly, and cannot result from a de facto situation: in the absence of an explicit and currently valid written agreement, the standard regime (first payment only) applies.

Payment request and processing time

  • Payment methods and minimum thresholds: The Affiliate may request payment of accumulated commissions from their customer area, according to the following methods: PayPal (minimum threshold €50) or MineStrator.com internal credits (minimum threshold €1) usable on the Services. No payment by bank transfer or any other means is currently offered.
  • Processing time: Valid payment requests are processed by OctoGency within a maximum of thirty (30) business days of receipt of the request. This time period allows OctoGency to verify the absence of any pending refund that could affect the balance, to perform anti-fraud checks, and to execute the actual transfer.
  • No fees: OctoGency applies no fees on the payment of commissions to the Affiliate. Any fees charged by third-party payment operators (notably PayPal) remain at the Affiliate's expense where applicable.
  • Taxation: The Affiliate is solely responsible for the tax and social-security declaration of their affiliate revenue to the competent authorities of their country of residence.
  • Maximum cumulative balance pending payment: The Affiliate's cumulative commission balance pending payment may not exceed two thousand euros (€2,000). Beyond this threshold, new commissions generated are not credited to the Affiliate's balance and are definitively forfeited. It is the Affiliate's responsibility to monitor their balance and regularly request the payment of their commissions to remain below this threshold. An alert is provided in the customer area when the balance approaches the threshold.
  • Expiry of unpaid commissions: In accordance with Article 2254 of the French Civil Code, commissions credited to the Affiliate's balance expire and are deemed waived in OctoGency's favor at the end of a period of twelve (12) months from their date of acquisition, in the absence of a valid payment request by the Affiliate. To enable the Affiliate to avoid expiry, OctoGency undertakes to notify the Affiliate by email and through an alert in their customer area at least thirty (30) days before the expiry of each commission, inviting them to request its payment before the deadline.

Affiliate's obligations

As part of their participation in the program, the Affiliate undertakes to comply with the following obligations, the breach of which may result in the immediate termination of their affiliate account and the cancellation of any pending commissions:

  • Advertising transparency: The Affiliate undertakes to comply with the applicable advertising regulations, and in particular the transparency obligation requiring the explicit disclosure of the advertising or affiliate nature of their communications. To that end, the Affiliate must clearly display, on any sponsored content promoting the Services (video, social-media post, article, podcast, stream), a disclosure such as “affiliate link”, “partnership”, “advertising”, or “#ad”. This obligation applies in particular to the YouTube, TikTok, Twitch, Instagram, X (formerly Twitter), and Discord platforms, and to any other distribution channel, whether regulated or not.
  • Prohibition of indirect self-affiliation (cross-accounts): The Affiliate undertakes not to use their own affiliate code, directly or indirectly, to generate commissions on their own payments. While MineStrator.com technically blocks the use of an Affiliate's code on their own account, this technical safeguard does not exempt the Affiliate from complying with the prohibition on indirect self-affiliation through cross-accounts: it is strictly forbidden to create or use secondary accounts, accounts held by complicit third parties, or any equivalent arrangement for the sole purpose of circumventing this detection. Any payment made through such circumvention does not give rise to any commission; the practice results in the immediate closure of the Affiliate account, the cancellation of pending commissions, and, where applicable, fraud proceedings.
  • Prohibition of cookie-stuffing, spam, and manipulation: The following are strictly prohibited: cookie-stuffing (forcing the placement of the affiliate cookie without the visitor's deliberate action, via hidden iframes, pixels, automatic redirections, or any equivalent arrangement), spam (mass unsolicited sending of emails, private messages, or comments containing the affiliate link), the creation of misleading web pages imitating the MineStrator.com site or implying an unsubstantiated official partnership, as well as any technical manipulation of third-party cookies or attribution mechanisms.
  • Prohibition of disparagement and fraud: The Affiliate shall not publicly disparage MineStrator.com, OctoGency, or competitors in their promotional communications. The Affiliate also undertakes not to make or facilitate fraudulent payments (use of stolen bank cards, circumvention of anti-fraud controls, falsified identities) in order to generate commissions.
  • Compliance with intellectual property: The Affiliate's use of official graphic elements (MineStrator logos, Strator mascot, customer panel screenshots, registered trademarks) is limited to promotional materials strictly related to the affiliate program and remains subject to the Intellectual Property section of these GTCS. Any modification distorting OctoGency's visual identity or implying an unformalized institutional partnership is prohibited.
  • Compliance with applicable law: The Affiliate undertakes not to promote the Services on unlawful channels or content, and in particular on piracy sites, counterfeit sites, content of a pornographic nature involving minors, content inciting hatred, or content infringing French law or the law applicable in the Affiliate's country of residence.
  • Prohibition of distribution on promotional-code aggregator sites: The Affiliate undertakes not to distribute, have distributed, or submit their affiliate code on websites, platforms, applications, or browser extensions primarily dedicated to the listing, aggregation, or sharing of promotional codes and discount coupons. This prohibition targets channels whose primary purpose is to capture traffic from users seeking a discount code at the time of their purchase, rather than actively promoting MineStrator.com's Services to a targeted audience. Where such distribution is detected, OctoGency shall, without prior notice, proceed with the random regeneration of the affected affiliate code and the definitive blacklisting of the original code, which becomes inoperative. Commissions generated via the former code prior to detection remain earned by the Affiliate; however, attributions that occurred between the abusive distribution on a prohibited channel and detection may be cancelled and removed from the balance where the correlation between such attributions and the abusive distribution can reasonably be established. In the event of repeat offense, OctoGency reserves the right to terminate the affiliate account under the conditions set out in the section relating to termination.

Program modifications and termination

The terms of the affiliate program may evolve over time. OctoGency reserves the following rights, subject to reasonable notice and to the commitments made to active Affiliates:

  • Modification of terms: OctoGency may modify the commission scale, tier thresholds, payment methods or minimum payment thresholds, attribution cookie duration, or any other parameter of the program, subject to a written notice of thirty (30) days sent to active Affiliates (notification in the customer area or by email). The modifications apply to commissions generated after the entry into force of the new version, without retroactive effect on commissions already earned.
  • Immediate termination for material breach: In the event of a material breach by the Affiliate of their obligations (self-affiliation via cross-accounts, payment fraud, cookie-stuffing, mass spam, public disparagement, infringement of OctoGency's intellectual property, use of prohibited codes, promotion on unlawful channels), OctoGency may terminate the Affiliate account immediately and without notice, cancel all pending commissions, and initiate any useful recovery proceedings in the event of harm suffered.
  • Discretionary termination with notice: Outside of cases of material breach, OctoGency may terminate an Affiliate account at its discretion subject to a written notice of thirty (30) days sent to the Affiliate, without having to justify its decision. Commissions generated before the end of the notice period remain due to the Affiliate, subject to reaching the applicable minimum payment threshold.
  • Pending commissions at termination: In the event of termination at the Affiliate's initiative, commissions accumulated below the minimum payment threshold (€50 PayPal / €1 credits) remain earned for twelve (12) months from termination, during which the Affiliate may reach the threshold through any additional commissions or request payment by exception through the support. Beyond this period, amounts below the threshold are deemed waived in OctoGency's favor.

Data Portability and Reversibility #

In accordance with the European Data Regulation (Data Act, Regulation (EU) 2023/2854) which came into force on September 12, 2025, MineStrator.com guarantees the Client effective portability and reversibility of data stored on the hosted services, without technical obstacles or abusive fees.

  • Permanent access to data: Throughout the duration of the contract, the Client has full access to their data (worlds, saves, configurations, plugins, mods, scripts and other files related to their server) via the SFTP/FTP protocols integrated into the service. This access is included at no additional cost and allows downloading all data at any time.
  • Open formats: Data is stored and restored in its original raw formats, specific to each game (e.g., standard save files). No proprietary or locked format obstructs portability.
  • Post-expiration period: The termination or stopping of subscription renewal by the Client does not cause any immediate Service suspension. The Client retains full access to data and the ability to retrieve it until the effective expiration date of the current Service.
  • Immediate post-expiration retention: For the fourteen (14) days following the effective expiration of the Service, MineStrator.com keeps the Client's last data backup immediately available, accessible via technical support for a final recovery.
  • Free-of-charge archiving beyond 14 days: Upon expiration of the fourteen (14) day period, the Service is deleted. The remaining MyBox data is then automatically archived free of charge by MineStrator.com (the Client bears no storage fees), within the following maximum durations:
    • Initial paid Service: archiving offered for up to ten (10) years;
    • Initial free Service (free trial included): archiving offered for up to one (1) year.

    Archiving is provided on a best-effort basis: MineStrator.com does not guarantee that archives will reach their full term. For operational reasons (periodic cleanup, storage capacity needs, technical incident, infrastructure evolution, etc.), all or part of the archives may be permanently deleted before the expiration of the above periods, without prior notice or compensation.
  • Archive restoration — sine qua non condition: The recovery or restoration of an archive is conditional upon prior subscription to a new paid Service by the Client. No access to archived data is possible without an active paid Service. This condition is express and enforceable: if the Client returns months or years after the archiving of their Service, they must first subscribe to a new paid Service in order to request the restoration of their archive (subject to its still being available, see the preceding clause on best effort).
  • Transfer assistance: In case of change of hosting provider, the Client may contact MineStrator.com technical support for any question relating to data export or transfer. No abusive fees or technical obstacles will be opposed to the Client wishing to exercise their portability right.

Moderation and Reporting of Illicit Content #

In accordance with the European Digital Services Act (Regulation (EU) 2022/2065), MineStrator.com, as a hosting intermediary service provider, implements a procedure allowing any user or third party to report the presence of allegedly illicit content hosted on its servers.

  • Reporting procedure: Any reporting of allegedly illicit content (child pornography, terrorism advocacy, incitement to hatred, organized harassment, racist remarks, manifest counterfeiting, etc.) can be sent to abuse [at] octogency.com or via the dedicated reporting form available on the website.
  • Required information: The report must include (a) the precise nature of the alleged infringement, (b) the URL or identifier of the server concerned, (c) a detailed description of the facts, and (d) the contact details of the reporter.
  • Processing time: MineStrator.com undertakes to process within twenty-four (24) hours any report concerning manifestly illegal content. For other reports, the reasonable processing time is set at seventy-two (72) working hours.
  • Immediate suspension: When the manifestly illegal nature of the content is established upon examination of the report, MineStrator.com immediately suspends the concerned server for the duration necessary for an in-depth review of the case and, if applicable, definitive removal of the content.
  • Client notification: The Client owning the affected server is informed by email of the report received, the possible suspension and MineStrator.com's reasoned decision (removal, restoration or request for additional information).
  • Right to contest: The Client has the right to contest MineStrator.com's decision through customer support, by providing any evidence allowing to establish the legality of the disputed content. MineStrator.com then re-examines the case within a reasonable time, and may decide to restore the content if the contestation is founded.

Intellectual Property #

  • Content and Tools: All elements (texts, images, software, logos, etc.) on the site and in the service are the exclusive property of MineStrator.com or its partners and are protected by intellectual property laws. MineStrator is a registered trademark with the INPI under number 4895312.
  • Reproduction: Any total or partial reproduction, representation, or distribution without the prior written permission of MineStrator.com is strictly prohibited.
  • Intellectual property of Client data and creations: The Client retains all intellectual property rights to the data, configurations, worlds, saves, builds, plugins, mods, scripts and creations they store on MineStrator.com services, regardless of the game hosted (Minecraft, ARK, Garry's Mod, Rust, Palworld, Valheim, Factorio, and any other game supported by the platform). The Client grants MineStrator.com a non-exclusive, free license limited to the duration of the contract, strictly necessary for hosting, backup, restitution and technical maintenance of this data. No commercial exploitation rights are assigned to MineStrator.com.

Liability and Warranties #

  • Commitment of Resources: MineStrator.com is committed to employing all reasonable means to ensure the continuity and quality of service.
  • Limitation of Liability: MineStrator.com cannot be held liable for any interruption or malfunction of the service resulting from:
    • a case of force majeure (see dedicated clause below),
    • scheduled maintenance operations,
    • failures of telecommunications networks or third-party providers.
  • Technical Support: Technical support is available to the Client for any assistance or problem resolution. The specific terms of this support are available on the website.
  • Liability cap:
    Professional Clients: For Clients who have subscribed to the Services in the context of their professional activity, MineStrator.com's total liability, all causes combined (contractual breach, data loss, Service unavailability, etc.), is expressly limited to the amount paid by the Client during the twelve (12) months preceding the triggering event of liability. This limitation does not apply in case of gross or intentional fault by MineStrator.com.
    Consumer Clients: For consumer Clients, MineStrator.com is fully liable for its breaches within the conditions and limits provided for by the applicable French law (notably the French Consumer Code and the French Civil Code). In accordance with Article R. 212-1 6° of the French Consumer Code, no provision of these GTCS shall have the effect of suppressing or reducing the consumer's right to obtain reparation for the loss suffered in case of breach by MineStrator.com.
  • Legal warranties: The consumer Client benefits, for the services offered by MineStrator.com (hosting of multi-title game servers and related services, qualified as digital services under French law), from the following legal warranties:
    Legal warranty of conformity for digital content and services (French Consumer Code art. L224-25-12 et seq., introduced by Ordinance No. 2021-1247 of 29 September 2021): MineStrator.com guarantees that the Service complies with what is announced to the Client (technical characteristics, allocated resources, features, supported game) throughout the duration of the Service supply, and for a minimum of two (2) years from the supply. In case of lack of conformity, the Client may demand bringing the Service into conformity; failing that, the Client may obtain a price reduction or the termination of the contract under the conditions provided for by law.
    Warranty against hidden defects (French Civil Code art. 1641 et seq.): MineStrator.com guarantees the Service against hidden defects making it unfit for its intended use.
    These legal warranties apply independently of the commercial warranty granted by MineStrator.com (notably the 99.5% SLA defined in the dedicated section), which constitutes an additional contractual commitment by MineStrator.com.

Force Majeure #

Neither party shall be held liable for failure to fulfill their obligations due to a force majeure event, as defined by case law (natural disasters, strikes, conflicts, Internet network failures, etc.).

Privacy and Personal Data Protection #

Collection and Processing

When creating an account and using the services, MineStrator.com collects the following information:

  • User Data: Username, email address, and IP address.
  • Analytics Tools: The site uses Google Analytics 4 (audience measurement) and Microsoft Clarity (session recording and heatmaps) to analyze traffic, understand user journeys and improve experience. Applied configuration: IP address anonymization, exclusion of sensitive fields.
  • Payment: Payment platforms (PayPal, Dedipass, Stripe, Paysafecard) process additional transaction-related information. MineStrator.com retains only a unique number to identify the Client.

Cookies and trackers

The MineStrator.com site uses cookies and trackers for the following purposes: (a) management of the Client's account and session (authentication, display preferences such as language and theme, ongoing shopping carts); (b) audience measurement and user journey analysis via the third-party tools listed in the "Analytics Tools" sub-section above; (c) operation of the services entrusted to the providers listed in the "Subprocessors" sub-section (payment, support, etc.). The Client may block or delete cookies at any time through their browser settings, without affecting the essential functioning of the Service (subject, where applicable, to the loss of customized preferences and the need to log in again). Detailed retention periods are set out in the "Data retention periods" sub-section below.

Data Usage

The collected data is used for:

  • Manage accounts and orders;
  • Provide, maintain, and improve the services;
  • Ensure security and fraud prevention.

Subprocessors

In accordance with Article 28 of the GDPR, MineStrator.com relies on several subprocessors for the performance of its services. These subprocessors only have access to the Client's personal data to the extent strictly necessary to perform their mission, and are contractually bound to comply with the confidentiality and security obligations set out in the GDPR.

Data transfers outside the European Union

Some subprocessors listed above may process personal data outside the European Union, notably in the United States. In accordance with Chapter V of the General Data Protection Regulation (GDPR), such transfers are governed by the Standard Contractual Clauses adopted by the European Commission (Decision 2021/914 of 4 June 2021) and, where applicable, by the EU-U.S. Data Privacy Framework adequacy framework (European Commission adequacy decision of 10 July 2023). MineStrator.com ensures that any transfer of data outside the EU is governed by appropriate safeguards within the meaning of the GDPR.

Security

MineStrator.com implements appropriate technical and organizational measures to protect Clients' personal data. No sensitive data is stored on the servers of MineStrator.com, except for the unique number that allows the identification of the Client's payment methods.

Security incident notification: In the event of a personal data breach presenting a risk to the Client's rights and freedoms, MineStrator.com undertakes to notify the CNIL within a maximum of seventy-two (72) hours after becoming aware of it, and to inform the affected Clients without undue delay when the breach is likely to result in a high risk, in accordance with Articles 33 and 34 of the General Data Protection Regulation (GDPR).

Data retention periods #

Personal data collected is retained for a period not exceeding what is necessary for the purposes for which it is processed:

  • Client accounts: 3 years from the Client's last interaction (login, purchase, support).
  • Accounting and billing data: 10 years (legal obligation under the French Commercial Code).
  • Connection and security logs: 1 year (CNIL recommendations and LCEN obligations).
  • Audience measurement and tracking cookies: 13 months maximum (CNIL recommended duration).

Customer Rights

In accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act, the Client has the following rights, among others: access, rectification, erasure, restriction of processing, objection, and data portability. The Client can independently delete their account directly from their client area. To exercise the other rights, you can contact our DPO at dpo [at] octogency.com or support at contact [at] minestrator.com. In case of persistent disagreement, the Client also has the right to lodge a complaint with the CNIL (French Data Protection Authority) — www.cnil.fr.

Commercial communications

If the Client has agreed to receive commercial communications when creating their account or subsequently, MineStrator.com may send them emails relating to its offers, events and promotions. The Client may at any time withdraw their consent via the unsubscribe link present in each email or by modifying their preferences from their client area. This withdrawal is free, immediate and does not affect the continuity of the subscribed Service.

  • Procedure: In case of a dispute, the Client is encouraged to contact customer service to find an amicable solution.
  • Response time: MineStrator.com undertakes to provide an initial response to any support request or complaint within a maximum of twenty-four (24) hours, excluding French public holidays and exceptional cases (major infrastructure outage, force majeure). For complex requests requiring in-depth technical investigation, this time corresponds to the initial handling of the request; the time to full resolution may vary depending on the nature and complexity of the problem encountered.

Modifications to the General Terms and Conditions of Sale #

MineStrator.com reserves the right to modify these General Terms and Conditions of Sale at any time. Changes will be communicated to Clients via email and/or through a notification on the site, with an effective date allowing the Client to review the changes before they come into effect.

Applicable Law and Jurisdiction #

  • Governing Law: These General Terms and Conditions of Sale are governed by French law. However, for consumer Clients habitually residing in another Member State of the European Union, the mandatory provisions of the law of the country of habitual residence protecting the consumer remain applicable in accordance with Article 6 of Regulation (EC) No 593/2008 (Rome I).
  • Jurisdiction: In the event of a dispute with a professional Client, the courts of MineStrator.com's registered office shall have exclusive jurisdiction. For consumer Clients, the legal rules of territorial jurisdiction apply: the consumer Client may bring the case before the court of the place where they resided at the time of conclusion of the contract or the occurrence of the harmful event, or that of MineStrator.com's registered office.

Severability of Clauses #

If one or more provisions of these General Terms and Conditions of Sale are held to be invalid, illegal or unenforceable by court decision or by any subsequent text, the other provisions retain their full force and scope. The parties shall then endeavor to replace the invalidated provision with a valid provision of equivalent economic and legal effect.
